These Terms & Conditions (“Terms”) apply to purchases made on itbart.eu (the “Store”). By placing an order, you agree to these Terms. If you have questions, contact us at shop@itbart.eu.
1. Products
We sell collectible model cars and related items. Product photos and descriptions are provided as accurately as possible. Minor differences (e.g., packaging variations) may occur.
In-stock vs pre-order / supplier order
Some items are marked or treated as in-stock (available for immediate dispatch). Some items are offered as pre-orders or are ordered from suppliers (e.g., Hachette, DeAgostini) after you place an order. Dispatch times are described on the Shipping page and/or the product page.
2. Prices & currency
Prices are shown in EUR and include/exclude taxes as indicated at checkout (depending on your configuration). Shipping costs are added at checkout unless stated otherwise.
We reserve the right to change prices at any time, but changes do not affect orders already accepted.
3. Orders & acceptance
An order is placed when you complete checkout. We may refuse or cancel an order in cases such as:
- payment failure,
- suspected fraud,
- obvious pricing errors,
- product unavailability (especially for supplier-ordered items).
If we cancel an order after payment, we will refund you.
4. Payment
Payment methods available at checkout may include PayPal and card payments (via payment providers). Payment is due at the time of purchase unless explicitly stated otherwise.
5. Shipping & delivery
Delivery options, dispatch times, destinations, and shipping costs are described on the Shipping page. Risk of loss passes to the customer upon delivery, unless consumer law provides otherwise.
If a parcel is returned due to an incorrect/incomplete address, re-shipping costs may apply.
6. Returns & refunds
Returns and refunds are described on the Returns page.
If you are an EU consumer, you generally have a 14-day right of withdrawal starting from the day you receive the goods, subject to legal exceptions.
7. Complaints & damaged items
If an item is damaged in transit or defective, contact us at shop@itbart.eu as soon as possible (preferably within 48 hours of delivery) and include photos of the item and packaging. We will propose an appropriate solution (replacement/refund) depending on availability and circumstances.
8. Liability
We are not liable for delays caused by events beyond our reasonable control (e.g., carrier delays, customs processing, supplier delays).
Nothing in these Terms limits consumer rights that cannot be excluded under applicable law.
9. Privacy
Personal data is processed according to our Privacy Policy.
10. Governing law
These Terms are governed by the laws applicable to the store operator’s place of establishment, without prejudice to mandatory consumer protection laws that apply to you.
